Terms and Conditions for Accommodation Contract
These are the terms and conditions that apply upon staying at THE BASICS FUKUOKA. Please ensure to read them before using the Hotel.
Scope of Application
Paragraph 1
- Accommodation contracts concluded by the Hotel with Guests and related contracts shall be governed by these Terms and Conditions. Matters not provided for in these Terms and Conditions shall be governed by laws and regulations (refers to laws and regulations or something based thereon; the same applies hereinafter.) or generally established customs.
- If the Hotel complies with a special provision to the extent that it does not violate laws and regulations or customs, notwithstanding the provisions of the preceding item, that special provision shall prevail over these Terms and Conditions.
Application for Accommodation Contract
Paragraph 2
- A person seeking to apply for an accommodation contract at the Hotel is requested to provide the following to the
Hotel.
(1) Name of Guest
(2) Date of stay and estimated time of arrival
(3) Accommodation fee (In principle, this will be based on the basic accommodation fee in Attached Table 1.)
(4) Other items deemed necessary by the Hotel - If, during their stay, Guests request to continue their stay beyond the day of stay set forth in Item 2 of the preceding paragraph, the Hotel shall deem this as a request for a new accommodation contract having been made at the time that request is made.
Conclusion, Etc. of Accommodation Contract
Paragraph 3
An accommodation contract shall be concluded when the Hotel accepts the request in the preceding paragraph.
Request for Cooperation in Infection Control Measures at Facilities
Paragraph 4
The Hotel may request persons seeking accommodation to cooperate in accordance with Article 4-2, paragraph (1) of the Hotel Business Act (Act No. 138 of 1948, including subsequent revisions; the same applies hereinafter).
Refusal to Conclude Accommodation Contract
Paragraph 5
The Hotel may not accept the conclusion of an accommodation contract in the following cases. Note this item does not
mean that the Hotel may refuse accommodation in cases other than those listed in Article 5, paragraph (1) of the Hotel
Business Act.
(1) If the application for accommodation does not comply with these Terms and Conditions.
(2) If it is found that the person seeking accommodation is likely to commit an act contrary to the provisions of laws
and regulations, etc., public policy, or morality in connection with accommodation.
(3) If the person seeking accommodation is a patient, etc. with a specified infectious disease prescribed in Article
4-2, paragraph (1), item (ii) of the Hotel Business Act (hereinafter referred to as “patient, etc. with a specified
infectious disease”).
(4) If it is found that the person seeking accommodation is likely to engage in gambling or other illegal activities
or
conduct that violates public morals.
(5) If the person seeking accommodation has repeatedly made the following requests to the Hotel, which are likely to
significantly hinder the provision of accommodation services to other Guests due to the excessive burden involved in
carrying out the requests.
① A request for a reduction of accommodation charges or any other matter that is not easy to realize (Excluding
cases
in
which the removal of social barriers prescribed in Article 2, item (ii) of the Act on the Elimination of
Discrimination
on the Basis of Disability (Act No. 65 of 2013, including subsequent revisions; the same applies hereinafter.) is
requested with regard to accommodation).
② A demand involving rude or violent speech or conduct or any other speech or conduct that is physically or mentally
burdensome to the employees (Excluding cases arising from the unjust discriminatory treatment of persons who seek
accommodation as prescribed in Article 8, paragraph (1) of the Act on the Elimination of Discrimination on the Basis
of
Disability by the business operator or cases for which there are reasonable grounds equivalent thereto) that
requires
more effort than is normally required to treat the person making the demand.
(6) If there is no room at the accommodation facility.
(7) If the person seeking accommodation is a drunken person, etc., and it is recognized that the person is likely to
cause extreme inconvenience to other Guests.
(8) If the person seeking accommodation has said or done anything that is extremely troublesome to other Guests.
(9) If the person seeking accommodation falls under any of the following.
① A person or organization that falls under any of the following (i) through (ix)
(i) An organized crime group prescribed in Article 2, item (ii) of the Act on Prevention of Unjust Acts by
Organized
Crime Group Members (Act No. 77 of 1991, including subsequent revisions; the same applies hereinafter)
(hereinafter
referred to as “organized crime group”)
(ii) An organized crime group member prescribed in Article 2, item (ii) of the Act (hereinafter referred to as
“organized crime group member”)
(iii) A quasi-member of an organized crime group
(iv) A company affiliated with an organized crime group
(v) A corporate racketeer, social activist, or special intellectual crime group, etc.
(vi) A person for whom five years have not passed since they ceased to be an organized crime group member
(vii) A person who is deemed to have a deep personal, capital or economic relationship with any of (i) through
(vi)
above
(viii) Another person equivalent to (i) to (vii) above
(ix) A person or organization that falls under any of the following (a) through (e)
(a) Having a relationship in which management is found to be controlled by a person listed in (i) through (viii)
above
(hereinafter referred to as “organized crime group member, etc.”)
(b) Having a relationship in which an organized crime group member, etc. is found to be substantially involved
in
business management
(c) Having a relationship in which the person is found to be unjustly using an organized crime group member,
etc.,
such
as doing so for the purpose of acquiring an unlawful gain for the person or a third party or for the purpose of
causing
damage to a third party
(d) Having a relationship in which the person is found to be involved in such a way as providing funds, etc. or
benefits
to an organized crime group member, etc.
(e) Having a relationship in which an officer or a person substantially involved in management has a socially
reprehensible relationship with an organized crime group member, etc.
② A person or organization that has committed any of the following acts
(i) An violent act of demand
(ii) An unreasonable demand beyond legal responsibility
(iii) An act of using threatening words or conduct or using violence in connection with a transaction
(iv) An act of spreading rumors, damaging the reputation of the Hotel or the company operating the Hotel
(hereinafter
referred to as “Company”) with the use of fraudulent means or use of force, or an act obstructing the business of
the
Hotel or Company
(v) Another person equivalent to (i) to (iv) above
(10) If it is impossible to grant accommodation due to a natural disaster, failure of facilities or other unavoidable
reasons.
(11) If there are other grounds specified by a Prefectural Ordinance where the Hotel is located.
Explanation of Reason for Refusal to Conclude Accommodation Contract
Paragraph 5-2
A person seeking accommodation may request to the Hotel that it explain the reasons for its refusal to enter into an accommodation contract in accordance with the preceding Paragraph.
Right of Guests to Cancel Contract
Paragraph 6
- Guests may cancel their accommodation contract by requesting such to the Hotel.
- If Guests cancel the accommodation contract in whole or in part due to reasons attributable to the Guest, the Hotel shall charge a penalty as listed in Attached Table 2.
- If Guests do not arrive by 10:00 PM (If the estimated arrival time is specified in advance, the time at which two hours have elapsed since the specified time) on the day of the Guest’s stay without making any contact, the Hotel may deem the agreement to have been cancelled by the Guest.
Right of Hotel to Cancel Contract
Paragraph 7
- The Hotel may cancel an accommodation contract in the following cases. Note this item does not mean that the Hotel
may refuse accommodation in cases other than those listed in Article 5, paragraph (1) of the Hotel Business Act.
(1) If it is found that the Guest is likely to commit an act contrary to the provisions of laws and regulations, etc., public policy, or morality in connection with accommodation. or if it is found that the person has committed that act.
(2) If the Guest is a patient, etc. with a specified infectious disease.
(3) If it is found that the Guest is likely to engage in gambling or other illegal activities or conduct that violates public morals.
(4) If the Guest has repeatedly made the following requests to the Hotel, which are likely to significantly hinder the provision of accommodation services to other Guests due to the excessive burden involved in carrying out the requests. ① A request for a reduction of accommodation charges or any other matter that is not easy to realize (Excluding cases in which the removal of social barriers prescribed in Article 2, item (ii) of the Act on the Elimination of Discrimination on the Basis of Disability) is requested with regard to accommodation).
② A demand involving rude or violent speech or conduct or any other speech or conduct that is physically or mentally burdensome to the employees (Excluding cases arising from the unjust discriminatory treatment of persons who seek accommodation as prescribed in Article 8, paragraph (1) of the Act on the Elimination of Discrimination on the Basis of Disability by the business operator or cases for which there are reasonable grounds equivalent thereto) that requires more effort than is normally required to treat the person making the demand. (5) If the Guest is a drunken person, etc., and it is recognized that the person is likely to cause extreme inconvenience to other Guests.
(6) If the Guest has said or done anything that is extremely troublesome to other Guests.
(7) If the Guest falls under any of the following. ① A person or organization that falls under any of the following (i) through (ix) (i) An organized crime group
(ii) An organized crime group member
(iii) A quasi-member of an organized crime group
(iv) A company affiliated with an organized crime group
(v) A corporate racketeer, social activist, or special intellectual crime group, etc.
(vi) A person for whom five years have not passed since they ceased to be an organized crime group member
(vii) A person who is deemed to have a deep personal, capital or economic relationship with any of (i) through (vi) above (viii) Another person equivalent to (i) to (vii) above
(ix) A person or organization that falls under any of the following (a) through (e) (a) Having a relationship in which an organized crime group member, etc. is found to be involved in business management
(b) Having a relationship in which an organized crime group member, etc. is found to be substantially involved in business management
(c) Having a relationship in which the person is found to be unjustly using an organized crime group member, etc., such as doing so for the purpose of acquiring an unlawful gain for the person or a third party or for the purpose of causing damage to a third party
(d) Having a relationship in which the person is found to be involved in such a way as providing funds, etc. or benefits to an organized crime group member, etc.
(e) Having a relationship in which an officer or a person substantially involved in management has a socially reprehensible relationship with an organized crime group member, etc. ② A person or organization that has committed any of the following acts (i) An violent act of demand
(ii) An unreasonable demand beyond legal responsibility
(iii) An act of using threatening words or conduct or using violence in connection with a transaction
(iv) An act of spreading rumors, damaging the reputation of the Hotel or Company with the use of fraudulent means or use of force, or an act obstructing the business of the Hotel or Company
(v) Another person equivalent to (i) to (iv) above (8) If it is impossible to grant accommodation due to a natural disaster, failure of facilities or other unavoidable reasons. (9) Smoking in bed in the bedroom, tampering with fire-fighting equipment, etc., or otherwise failing to comply with the rules of use set by the Hotel.
(10) If there are other grounds specified by a Prefectural Ordinance where the Hotel is located. - In the event that the Hotel cancels the accommodation contract in accordance with the provisions of the preceding item, no charges will be charged for accommodation services that have not yet been provided to the Guest.
Explanation of Reason for Cancellation of Accommodation Contract
Paragraph 7-2
A Guest may request to the Hotel that it explain the reasons for cancelling an accommodation contract in accordance with the preceding Paragraph.
Registration of Accommodation
Paragraph 8

Guests are requested to register the following information at the front desk of the Hotel on the day of their
stay.
(1) Name, address, and contact information of the Guest
(2) Nationality and passport number in the case of a foreign national without a domicile in Japan. Guests shall agree to the Hotel verifying their passport and making a copy of it.
(3) Site of accommodation on the previous day
(4) Other items deemed necessary by the Hotel - If Guests seek to pay the fee stipulated in Paragraph 11 by a traveler’s check, accommodation voucher, credit card, or other means in lieu of currency, Guests shall present that payment in advance at the time of registration set forth in the preceding item.
Guest Room Usage Hours
Paragraph 9
- Guests can use Guest rooms at the Hotel from 2:00 PM to 11:00 AM the following day. Note that for continuous stays, Guests can use Guest rooms all day except on the arrival and departure days.

Notwithstanding the provisions of the preceding item, the Hotel may allow the use of Guest rooms outside the hours
specified in the preceding item. In such cases, the following additional fees shall be charged.
(1) An amount separately determined by the Hotel for each additional hour
(2) The full amount of the room charge should additional time be spent up to and/or beyond 2:00 PM the following day
Observance of Usage Rules
Paragraph 10
Guests in our Hotel are subject to the usage rules established by and posted in the Hotel.
Payment of Fees
Paragraph 11
- The breakdown of accommodation fees, etc. to be paid by Guests and the method of calculating them shall be as shown in Attached Table 1.
- Payment of the accommodation item set forth in the preceding paragraph shall be made at the front desk at the time of registration of the accommodation or upon request by the Hotel in Japanese currency or other means approved by the Hotel in lieu of currency such as traveler’s checks, accommodation vouchers, or credit cards.
- Even if Guests does not voluntarily stay after the Hotel provides them with a Guest room and it becomes available for use, Guests will still be charged the accommodation fee.
Responsibility of Hotel
Paragraph 12
- The Hotel shall compensate for any damage caused to Guests in the performance of the accommodation contract and related contracts or as a result of the non-performance thereof. However, this shall not apply if the cause is not attributable to the Hotel.
- The responsibility of the Hotel for Guest accommodation begins when Guests register at the front desk of the Hotel and ends when Guests vacate their Guest room to leave.
- The Hotel has taken out a hotel liability insurance policy in case of fire, etc.
Handling of Instances When Guest Room under Contract Cannot Be Provided
Paragraph 13
- If the Hotel is unable to provide Guests with the Guest room under their contract, it shall, with the consent of the Guest, find another accommodation facility with the same conditions as possible.
- Notwithstanding the provisions of the preceding item, in the event that the Hotel is unable to find another accommodation facility, it shall pay compensation equivalent to the penalty listed in Attached Table 2 to the Guest. This compensation shall be applied to the amount of damages. However, if there is no reason attributable to the Hotel that Guest rooms cannot be provided, the Hotel will not pay compensation.
Handling of Deposited Articles, Etc.
Paragraph 14
- In the event of loss, damage or other damages that arose with respect to the articles or valuables left at the front desk by Guests, the Hotel shall compensate for those damages unless it is due to force majeure. However, with respect to cash and valuables, if the Hotel requests a clear declaration of the type and value thereof and the Guest fails to do so, the Hotel shall compensate for damages up to 50,000 yen.
- In the event that any goods, cash or valuables brought into the Hotel by Guests that not deposited at the front desk are lost or damaged due to an intentional or negligent act of the part of the Hotel, the Hotel shall compensate for the associated damages. However, barring cases where there was an intentional or negligent act of the part of the Hotel, the Hotel shall compensate for damages only up to 50,000 yen in cases where the type and value of the goods, cash or valuables have not been clearly disclosed by the Guest in advance.
- The Hotel cannot hold on to items such as art and antiques.
Storage of Baggage or Personal Effects of Guests
Paragraph 15
- If Guests’ baggage arrives in the Hotel prior to their stay, the Hotel will responsibly store it and hand it to the Guest upon check-in at the front desk, provided that the Hotel agrees to do so prior to the Guest’s arrival.
- In the event that any baggage or personal effects of Guests have been left behind in the Hotel after Guests have checked out, if the owner of that baggage or personal effects is identified, the Hotel shall contact the owner and request their instructions. However, if there are no instructions from the owner or the owner cannot be identified, the Hotel will keep the baggage or personal effects for three months, including the date they were found, after which the Hotel will deliver them to the nearest police station. Items that are prone to corrosion, such as beverages and food, will be disposed of the day after checkout.
- The responsibility of the Hotel for the storage of the baggage or personal effects of Guests in cases under the preceding two items shall be subject to the provisions of Item 1 of the preceding Paragraph in cases under Item 1 of this Paragraph and to the provisions of Item 2 of the preceding Paragraph in cases under Item 2 of this Paragraph.
Liability for Parking
Paragraph 16
If Guests use a parking area of the Hotel, as the Hotel simply leases that space, it is not responsible for the care of the vehicles whether or not Guests deposit a vehicle key with the Hotel. However, if the Hotel caused damages due to willful misconduct or gross negligence on its part in the management of the parking area, the Hotel shall be liable for those damages.
Responsibility of Guests
Paragraph 17
In the event that the Hotel incurs damages due to the intentional or negligent act of a Guest, that Guest shall compensate the Hotel for the damages.
Disclaimer
Paragraph 18
The use of computer communications from within the Hotel shall be conducted at the risk of users themselves. The Hotel and the Company are not responsible for any damages incurred by users as a result of interruption of service due to system failure or other reasons while in mid-use of computer communications. Additionally, if the Hotel, the Company, or a third party incurs damages due to conduct deemed inappropriate by the Hotel or Company in connection with the use of computer communications, the user shall provide compensation for those damages (including reasonable legal fees).

1. The percentage indicates the ratio of the penalty to the basic accommodation charge.
2. If the number of days of the contract is shortened or the number of Guests is reduced, the above penalty corresponding to each scheduled day of accommodation will be collected based on the date on which notification of contract cancellation was received.
*The above penalty constitutes the basic amount. If a reservation is made over a specific website, etc., the penalty provisions of the specific website, etc. will take precedence.
